1. General Terms

By accessing any part of this website and/ or placing an order with Braai Club Limited (BC ltd) (either through the website or directly) it is deemed that you agree to adhere to all conditions, terms and policies herein. All orders are accepted only upon and subject to these terms and conditions. References to terms “we”, “us”, “our” and the “Company” refer to BC ltd.

These terms apply to all users of the site, including without limitation those who are browsers, customers, merchants, and/ or contributors of content. Any new features or products added to the site shall be subject to these terms. BC ltd reserves the right to update, change or replace any part of these terms, without prior notice, by posting updates/ changes to the website. Continued use and access of the website following the posting of such changes constitutes acceptance of those changes.

2. Privacy Policy

BC ltd collects data about you to process orders and to provide the best possible service and information about our products. The information collected includes: your name; physical address; phone number; email address; and ordered history. When orders are placed with BC ltd, we maintain such order information for our records, unless and until you ask us to delete this information.

BC ltd will never collect sensitive information without your consent. The information we hold can be confirmed by emailing us. The personal information we hold will be secured in accordance with our internal security procedures and the law.

BC ltd may track patterns of behaviour of visitors to our website, including information about products and pages viewed, your web browser, IP address, time zone and cookies, which would be stored on your internet browser. The information collected can be used to identify you and can be prevented by modifying your browser settings.

BC ltd will only e-mail you should you have given us consent to do so; you will be able to opt out of any such communication at any time.

3. Cookies

Cookies allow the website to work more efficiently and provide information (but not personally identifiable) to BC ltd. By accepting cookies on BC ltd’s website you consent to sharing certain information with the company. Not accepting cookies may result in certain features of the website not working optimally. Users have the option to set their devices to accept cookies or not, which can be restricted or blocked by changing your browser settings.

5. Orders
​
Orders are subject to acceptance by BC ltd, the ability of BC ltd to supply the products, conditional on receipt of payment and there being no errors or misrepresentation. If for any reason we are unable to supply a particular product, we will notify you as soon as possible to offer an alternative or refund. If products cannot be provided within 30 days, payment will be fully refunded.

BC ltd reserves the right to refuse to supply any individual or company entirely or through limited quantities, which can be applied per person, per household or per order. All goods are sold for private retail consumption only, and on the condition that they will be not be resold, traded, or circulated in any way without our prior written consent of BC ltd. BC ltd reserves the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

6. Payment
​
All values are in UK pounds £ sterling and inclusive of mainland United Kingdom Duties, Taxes and VAT ruling at the time of purchase. Payment can be made by PayPal, Credit Card or Debit Card.

You will be charged for your order prior to it being dispatched. Goods remain the property if BC ltd until paid for in full.
​
Any mistakes on invoices, receipts or payments will be rectified as soon as possible, and at the latest within 30 days of agreement thereof.
​
BC ltd uses Wix Stores to host, develop and secure our website. Customer Security in Wix Stores is secured by HTTPS / TLS encryption. Wix Stores works with payment gateways that offer the highest level of security certification (PCI DSS Level 1).

7. Prices
​
Prices are subject to change at any time without prior notice and at the sole discretion of BC ltd. The prices (goods and delivery) at the time of order will prevail and be used to invoice customers – no price list of the Company, whether published or not, shall affect the right of BC ltd to charge for the goods in accordance with this clause. Forward purchased orders are subject to change due to fluctuation in prices, VAT, exchange rates, duties, courier and insurance charges.

All product weights are calculated including the product, product packaging and postage packaging, at point of manufacture and may be subject to change due to transportation. Courier charges are subject to change without notice and subject to the sole discretion of BC ltd and is no grounds to cancel an order.

8. Promotions, Discounts and Membership
​
All promotions and discounts issued by BC ltd shall be subject to correction and cancellation without notice and without any liability on the part of the Company. Promotions and discounted products are only available at the time the promotion is advertised and is subject to the availability of stock. Price promotions being “only valid while stocks last”, can be withdrawn at any time without notice, cancelling the promotion with immediate effect. BC ltd also reserves the right to discontinue any product and any time.

By signing up as a Braai Club Limited Member, members consent to receive marketing material from BC Ltd. As a condition precedent, the choice to opt-out from receiving marketing material will result in one's membership being suspended or cancelled.

9. Delivery Terms and Charges
​
BC ltd uses independent courier contractors. Although every effort will be made to deliver goods as ordered, BC cannot guarantee delivery timelines nor accept responsibility or liability for any loss, damage or spoilage arising from delay in delivery due to circumstances beyond our control or customers not being available to receive and sign for deliveries for any reason. These conditions will not be waived under any circumstances, and no cancellation of an order will be accepted if the reason relates to attempted delivery, in any way whatsoever.

Delivery dates and times are indicative estimates given in good faith and do not amount to any contractual obligation by BC ltd and are subject to change. To ensure products are received as intended and not subject to any spoilage, we ask that you avail yourself to receive deliveries on the day and time you are informed your orders will be arriving, or request delivery to an alternative address, like your business address.

The delivery charges are based on delivery in UK mainland (excluding some postcodes), extra charges may apply to delivery in other areas. Consumers will be informed of any price changes before delivery.
Delivery

Delivery will be made to the address specified on the completed order form, which can be to a home or business address. BC ltd and it’s courier partner(s) assume no liability for incorrect address information supplied by customers

All effort will be made to secure delivery within the time specified

Should there be no one at the address to receive the order, goods may be retained by the courier company, in which instance you will have to re-arrange a new delivery day with the courier company. A further delivery charge may be payable in such circumstances – it is not possible to cancel an order due to this charge
Our courier partner will endeavour to deliver the next day. You should receive a notification from them confirming collection with options in the event you won't be present for collection. In the event the undelivered package is returned to the courier's depot and delivered the next day, you agree to accept the delivery.

STANDARD DELIVERY SCHEDULE:
Order cut-off is 9am Monday to Friday, for next day delivery. Orders placed after 9am on Friday, will be collected Monday for delivery Tuesday. Currently shipping within England, Scotland and Wales (excluding Scottish Highlands and Islands).

10. Cancellation of Orders
​
Acceptance of cancellation of an order shall be at the sole discretion of BC ltd. Such acceptance may be subject to a cancellation fee/ penalty.
​
In circumstances where BC ltd has spent considerable effort obtaining goods specially requested by a customer, BC ltd reserves the right at its sole discretion not to allow cancellation or charge the customer the full cost including expenses incurred.

11. Freeze Down
​
BC ltd implements a freeze-down process in which relevant fresh meats are frozen after processing. All fresh meat products are dispatched frozen in temperature-controlled packaging with ice packs.
​
Please note that when frozen goods are sent, BC ltd cannot guarantee that these products will arrive frozen and therefore these goods should be consumed within 3 days of receipt. Due to the weather conditions or delays in delivery, it is possible for products to thaw, so please keep this in mind when ordering large quantities.

12. Storage – Biltong and Dry Wors
​
BC ltd wants each and every customer to enjoy our products as intended. As such, all goods should be stored as indicated on the individual product’s packaging. BC ltd cannot accept any responsibility where goods have been stored other than indicated or are subject to further processing, re-packaging or negligence by the customer.
​
Biltong and Dry Wors are air-dried products that are subject to mould and should be stored in a dry cool area away from direct sunlight and moisture. These products should be consumed within 1 day of opening the packaging and never consumed beyond the best before date indicated on the individual product’s packaging. Once open, place Biltong/ Dry Wors on an open plate on paper towel mixing/ turning daily, making sure to consume within 1 day.

If your preference is for wetter products, this means the product retains a larger amount of moisture and in turn has a higher susceptibility for mould formation. Please remember that in regions like the UK where there this high humidity, Biltong and Dry Wors are prone to mould formation and need to be stored correctly to avoid any spoilage. Moisture, surface contact, heat, and sunlight will result in mould formation.

Our products are sealed in appropriate packaging at a modified atmosphere and should remain sealed and intact until ready to be consumed. Once the packaging is opened, the products become exposed to external elements, even if the packaging is resealed.
​
Whole sticks of Biltong can be hung, in a cool, dry, well-ventilated area and never store in a sealed container, as it will release moisture and form mould. If vacuum packed remove from packaging once received, or freeze for another day. If not consumed after opening, store preferably hung in a cool, dry environment, but consume within 3 days of opening.

13. Returns, Refunds, Claims and Complaints
​
Braai Club Limited (BC ltd) endeavours to ensure our products are of the highest quality at all times. If you feel we have not met your expectations, please contact us immediately and we will endeavour to correct the situation or arrange a refund where applicable. Do not throw away any products you deem faulty until you have engaged with BC ltd, as these may be required as evidence to the fact. Due to the perishable nature of some products, we may not be able to offer a refund.

Any requests for refunds must be made within 7 days of receipt of the order. Delivery charges are not included in any refund policy and customers, where required, are responsible for the costs of returning any goods, unless otherwise agreed with BC ltd.
​
Any potential claim or complaint should be made directly in writing with BC ltd by emailing howzit@braaiclub.co.uk. BC ltd will endeavour to respond to all potential claims and complaints within 5 working days.

All goods must be counted and checked for damage upon receipt, and signed for as such.

Any shortage or damage must be indicated on the delivery note at the time of delivery and notified immediately to the courier company.

BC ltd must be notified in writing of any shortage or damage within 24 hours, for any potential claim to be investigated further, with photos of damage goods/ packaging being provided as evidence to the fact. Claims and complaints made after this period may not be entertained.

All complaints will be dealt with on merit. BC ltd takes every care to ensure products are sent in a good condition and packed securely. It will be at the Company’s sole discretion whether, or not to replace damaged goods due to the courier’s negligence.

No credit or refund will be passed for goods returned without prior agreement with BC ltd in advance and in writing. BC ltd reserves the right to recover costs where unauthorised returns are made. Any costs associated with the return of goods, with the permission of BC ltd, will be allocated between the parties at the discretion of BC ltd.

If requested by BC ltd, goods must be returned in the same condition and packaging they were received. BC ltd may not refund any costs for items returned damaged by yourself.

No credit or refund will be passed for any goods ordered in error by the customer, or due to any damage, losses or spoilage due to the incorrect storage, handling or customer negligence.

Any orders refused, not received or returned without the written consent of BC ltd will not be eligible for a refund.

No credit or refund will be passed for any orders cancelled due to late delivery.
BC ltd will endeavour to ensure refunds are passed within 30 days from the date of agreement thereof.

14. Gift Cards
​
Braai Club Ltd reserves the right to update and change the terms and conditions of our Braai Club Ltd gift cards at any time. This does not affect your legal rights. Use of your Braai Club Ltd gift card constitutes acceptance of our Terms and Conditions and we therefore recommend you read them carefully. It is your responsibility to check these gift card terms from time to time to ensure you are aware of any changes which may have been made. Braai Club Ltd gift cards remain the property of Braai Club Ltd who maintains the right to cancel the card in its sole discretion in situations where it is deemed necessary to do so (such as to comply with applicable laws or as a result of circumstances beyond its control).
Validity:

The value of your Braai Club Ltd gift card can be redeemed online at www.braaiclub.co.uk provided the gift card is redeemed within the applicable redemption period.

The gift card balance can not be exchanged for cash or redeemed against the purchase of another card.

Gift cards must be redeemed in full on a single purchase. No balance is payable or transferable.

Your Braai Club Ltd gift card is valid for a period of 6 months from the date of purchase, following which they expire automatically. A gift card cannot be used after the expiry date and the card will become invalid and no longer available for use. We have no obligation to remind or inform you of a gift card’s expiry and it is your sole responsibility to ensure that any balance is used in full prior to expiry.

A Gift Card expires automatically once its balance has been exhausted.

Gift Cards may be used to pay for the whole or any part of an in-store purchase or online order.

Only one gift card may be used per online order.
Lost/ Stolen / Damaged:

You are solely responsible for the safe keeping and security of your gift card following on-line delivery. In cases where your Braai Club Ltd gift card is lost or stolen, Braai Club Ltd is unable to replace the gift card. Braai Club Ltd cannot be held responsible for any balance lost on a Braai Club Ltd gift card as a result of theft or fraud.

Please retain an expired gift card should you wish to return your purchase. Any goods paid for using a gift card that are subsequently returned for a refund will be credited to the original gift card or in the event that you have discarded or misplaced your original card, issued on a new Braai Club gift card.

If the total to be refunded is more than originally paid by the Braai Club Ltd gift card, then any remaining refund balance will be refunded to the other method of payment used by you (i.e., debit/credit card or cash).
Data Protection:
Personal data relating to your purchase or use of a gift card will be used in accordance with current applicable data protection and privacy legislation as stated above in our Privacy Policy .
Governing Law and jurisdiction:
These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

15. Customer Comment and feedback
​
By sending us feedback and comments, you agree that we may, at any time, without restriction, edit, copy, publish, distribute and use in any medium such comments that you forward to us. BC ltd is under no obligation to maintain any comments in confidence, pay compensation for, or respond to any comments.

16. Illustrations
​
Every effort is made to ensure our website and documentation display as accurately the correct colours and images of our products. BC ltd cannot however, guarantee that your computer/ mobile devise display of our products will be accurate. All descriptions of products are subject to change without prior notice at the sole discretion of BC ltd.

17. Limitation of Liability
​
BC ltd, our directors, officers, employees, suppliers, service providers, affiliates, agents, contractors, or licensors shall not be liable (as permitted by law) for any injury, loss, claim, or any direct, indirect or consequential damage of any kind, including, without limitation lost profits, revenue, savings, data or any similar damages, arising from the use of any of our products, including, but not limited to, any errors or omissions in any content.

You agree to indemnify BC ltd of any claim or liability due to or arising out of your breach of these terms.

18. Errors, Omissions and Inaccuracies
​
BC ltd will not be liable for any errors, inaccuracies or omissions of information on our website or packaging that may relate to product pricing, descriptions, ingredients, allergens, offers, promotions, product shipping charges and availability. BC ltd reserves the right to correct any errors, omissions and inaccuracies or to change or update information or cancel orders if any information is inaccurate without prior notice, including after order has been placed. BC ltd is under no obligation to update, amend or clarify information relating to errors, omissions or inaccuracies, except as required by law.

Any error, omission or inaccuracies in any sales literature, website page, quotation, price list, acceptance of offer, invoice or other document or information issued by the Company shall be subject to correction without any liability on the part of BC ltd.
